I have a labor approved in Civil/Contruction job skills with PD Oct 2003 and my date is current now. However I am currently on a IT company H1-to be specific 'Business Analyst'.
will there be a problem being now on a IT company H1 and filing for 485 with the Civil/Contruction approved labor..?

I guess the genuine companies will move the H1/L1 staff abroad along with positions to meet this requirements if at all this becomes law. What that means is more job loss in US. (Whether US has 50% of total "high skilled" work force necessary to run the operations of all the companies is another important question... I do not think so, may be the senators are considering highschool dropouts to handle the "high skilled" jobs :), I read somewhere about a recent survey and only 27% of 25-45 age group of population has a college degree in all discipline. I will try to find the link)
Over all, I see this move by senators as short sited and will prove disastrus to America in long run given the fact that no other country in the world is as dependent on technology / research and development as US.
I also saw a quote from one of the Indian offshoring company CEOs that only 25% of Indian engineers are employable. May be highschool dropouts in US may not be that bad when contrasted against that statistics, after all Bill Gates was also a dropout. Also the dime-a-dozen so-called "engineering colleges" in India that feed Indian offshoring companies are known for QUANTITY and not QUALITY. Indian students go for (or their parents pay for) those courses offered in those colleges precisely because they offer a better future - i.e. they feel they get a good ROI on their investment, even if they don't have the interest or aptitude for Computer Science or engineering. These days, these facts are known to a lot of americans working in IT.
If H1/L1 visa is restricted, that will give an incentive for americans to acquire a degree in science/engineering, just like the indian students taking courses in india offering a better ROI, as they get the feeling that they won't be discriminated in a job and investing $$$ in education is not going to be wasted. This is what President Obama also emphasized today about the need for fundamental change in unemployment allowances helping to retrain the laid-off workers.
It will no doubt cut into the obscene profit margins of TCS/INFY etc., as they will be forced to play by the rules.

It is already there in change.gov. I have created long back in January and there were 470 votesup for that idea. I think now that will be in the President's desk. Only thing now we have to do is accelerate this so that it again reaches the Congress.

Not a good answer( but I reallly appreciate your frankness and I know you do speak for most of us here) and I have been doing exactly like this before 3 months. We must keep writing again and again and again. And make as many as we know also do it. It was when someone in this forum told me that I realized this and now I do it every week on change.gov. I write every week.
Obama will not come to you or me and tell us "Nice letter Sri, I read it and am acting on it". He gets 1000s of these everyday and in this economy and everyone wants to write to him., well except us who seems to have some comfort zone. we dont realize till its too late, and when it is, we create a new thread called " I got a pink slip yesterday". No offense,but we must act when we can, and before its late. Pink slip is more painful when you are on H1 than on GC. Right??.
Most of our folks (EB3) as it looks like want to wait.. scared to raise.. but dont realize they can contibute and help the economy.

Our friend Smitha doesn't understand the Problem at all.
I'm in this country since JAN 2000 but my actual Labor was filed in MAR 2005 because my 1st company SOLD my 1st labor ...... Its a PAIN you know - cycle of LC , 140, 485... Like cycle of birth and death...
Moreover Smitha is talking as if whoever "sent flower"/"stood in rally" made an assumption that a GREEN colored plastic card will be handed over straight off the Grill instantly !!!!!!

There are several people who has to re-file their labor for several reasons (employer greedy, company overtaken, laid-off, company gone bankrupt etc etc.). That does not mean that 2005-2006-2007 guys are asking that they should get GC before 2001-2004 people. What most of the people need is an ability to file for AOS so that they can indepenedent of the clutches of their employers.

I am not saying we initiate a strike or something like that, just gather together to have some (ideally at the same time) rallies to get media's attention. It even can be done at weekend. Say we can have 1K demonstrators at five big cities each across the nation - it must be something.
Afetr all, we are legal immigrants and our voices should be able to get delivered LOUDLY.
The only thing concerns me is the traffic of this web site, I sincerely hope someone can forward my post (not necessarily the original one, a better version) to some immigrant web sites so we can work together.
For me, I live in NJ, I have no problem driving to NYC on a Saturday morning to tell people what has been haunting us and is going to be haunting us for a long while.

I don't think it will do much good sueing uscis on this issue. The point is, they have the legal authority to be the one interporating the law. So, if there is "gray area" in the law, the law says it is their understanding that matters, not ours or any one else's. So, unless the law very specifically says it must be done in another way, you can not argue uscis did the wrong thing.
Now that we see the immigration law does not very specifically regulate how the flow should be like, so uscis have the authority to "understand the intention of the law" and act accordingly. You can't say you think the law means otherwise and thus sue uscis, because that argument makes no sense to the court. The court will only accept the argument when the government is apparently acting against the law.
We can definitely question them on how their understanding changed on visa spill over distribution.

NO LUD after Feb 2009 when i did my second finger printing.
Created SR thru NCSC, did not help.
Went to Infopass, no help from ppl i spoke with there.
Did congress man enquiry, not sure if this helped. (as of yday, they had not received a response from uscis and were still waiting for a reply)

Landed in this country on Aug-16-1997 for Masters. Today myself and my wife both got CPO mail/text message. Thanks IV community and good luck to all. I will be doing my part to make this system better!!!

Contacted Congress Woman on Aug 9 - Didn't get any useful info. I think, being in bay area, they might have been flooded with these requests.
Aug 10 - Opened an Infopass for Aug 18
Aug 16, 8:30 am - Dependent SR
Aug 16, 9:30 am - Called the customer service for primary's status - got the standard response that they sent a mail (which i didn't get) asking me to wait for 60 days.
Aug 16, 11:00 am - Wife called me to inform the good news, the online status change.
Aug 16, 11:05 am - got the text message (which just said "check your status online").
Aug 16: Got the CPO mail (time stamped 10:18am)
Guys (and Gals), Hang in there and you will have your independence soon.

In order to utilize all visas under given category , NVC will start preparing application and forward to consulate. NVC is rarely wrong in their prediction, sometime they do start processing app in case USCIS fails act on enough cases in last quarter and in case if they have to forward date ahead they want to make sure consulates are ready with file to close.
Since this is June 2007 case , they might be expecting real GC allocation upto April 2007 but they want to keep buffer of 2 months.If person who posted this info is not making april fool joke then PD in last quarter will be defiantly up to June 2007.

I signed up today morning but yet not received any confirmation email. How long it takes for getting a receipt email from them? Account status is showing pending when login into online account. Any idea.

I do received RD as July 2nd and ND: Oct 10 on RN. I am not planning to bug IO@NSC for EAD or NC untill Jan 2008 or I see my PD current per VB.

On my case they moved my file from NSC to TSC on 4 August and they used that date on my notice date as recp. date.. instead of 2 July.
I didnt get any response from my attorney yet.. but Shd I worry about getting my recp. dates corrected to 2 July.. I have PD of July 2003 EB3-India.
