    I came here in late 2006 and i have applied for 140 & 485 due to LS.
    All i can say for you is angoor khatte hain(grapes are sour for you) since you didnt get it.
    This is what happens to jealous people.

    Anyways, we have played by the rules.
    What do you say about people getting GC by lottery.
    Go and blame the govt for the rules not us.
    I don't care about LS. Almost all cases I know are fraud. Sometimes 2 guys got GCs on same labor(since they were not asking Original LC). Thank god USCIS banned LS.

    God Bless USCIS for banning LS.

    Guys, wakeup! He isn't telling anything wrong - just a different opinion, very valid for a great percentage of Indians - not everyone can/is going to land in US and wait eternally for GC? and nothing wrong in what he is saying - to go for a better long term India than a spurt of growth. Why ridicule the other guy for giving a genuine advice to youngsters - how many of us haven't almost given up on our careers just for the same of EB GC? Are we just afraid of losing out to our brothers in India in future, rather than them joining our batch in the eternal wait? If we want to make US our home, at least we should start respecting another person's right to his opinion, even if we disagree. Why would it be called a gimmick?! There is no other way - if its not India, it will be China, Philippines etc. Look at the way the general product industry went? The same will happen unless there are restrictive trade policy - which, not only would be against the "US" principals of free trade, but would also automatically be harmful for the US economy.

    I personally don't see anything wrong in the article. He puts forth the right things that can be done to improve the life of Indian generations - now and for future. And if that happens, there would be a benefit for us in particular, and US economy and US jobs in general.

    Washington - Colorado's Rep. Tom Tancredo and 70 other U.S. representatives sent a letter today to a Senate committee, warning that legislation it's considering allowing illegal immigrants to work legally in the country will hit a roadblock if it comes back to the House.

    The Senate's Judiciary Committee for the last two weeks has been debating an immigration reform bill that includes what's being called a “guest worker” program, something President Bush said he wants.

    “We are concerned that some of these proposals are fundamentally incompatible with the desire of the American public for real immigration reform and their clear opposition to reform proposals that amount to little more than thinly disguised attempts to provide amnesty," the House members said in the letter.

    “If the Senate were to pass such a proposal, we believe it would doom any chance of a real reform bill reaching the president's desk this year.

    Tancredo, R-Littleton, and the other 70 lawmakers were part of a group that led the passage of a bill in the House that imposes new border security measures, including increasing penalties for being in the country illegally.
    The House bill does not include a guest-worker provision. The group considers allowing illegal immigrants to stay in the country legally a form of amnesty.

    “Rewarding persons who have broken the law with an advantage that they would not otherwise have had encourages more illegal behavior and is unjust to immigrants who came to the U.S. legally,'' the letter says.

    Reps. Bob Beauprez, R-Arvada, and Joel Hefley, R-Colorado Springs, are among those who signed the letter.

    The Senate Judiciary Committee is not expected to finish work on the bill this week, which was the deadline given by Senate Majority Leader Bill Frist. He is expected to introduce his own bill possibly today that includes border security measures and does not have a guest worker provision.

    hey guys I think its OK now to call IV as Indian organization with this bulltin and per their statement there is a good chance that ROW will move ahead and we will be stuck EB3 India in particular

    If you don't stop saying comments like this, you'll totally alienated people like me. It is a global issue, doesn't matter where you are from. People from all nationalities are affected. Oh guess what, it wasn't just Indian nationals who saw no movement.

    Eb3I may nudge forward a little bit. Sadly that won't be very helpful to most folks on this board. Visa recapture is the only thing that can help near term. In the interim, administrative fixes, rule clarifications, USCIS efficiencies in application processings, Data transparency, though not glamorous victories as say visa recapture. Nonetheless make the path somewhat more comfortable and predictable.
    EB3ROW may move also.
    The movement of EB2I will be quite revealing for me. If there is quarterly spillover(which under current rules should be the case) then we might see some forward movement or at the very minimum the dates should stay put. However if there is no quarterly spillover, then with the approvals in EB2 recently, they will be hard pressed not to move dates backward somewhat.

    What was 245(i) amnesty?...just curious

    Section 245(i) is a part of the INA. In 2001, this section was updated to allow people present illegally to submit a labor certification. This resulted in the DOL getting 6 years worth of applications in April 2001. These applications led to the establishment of the Backlog Elimination Centers and the PERM process. The applications filed 6 years ago are still being processed by the DOL.

    Btw if you do not support DREAM ACT than you shouldn't be on this forum...

    At this point I am neutral on the DREAM act. Before I can support the DREAM act you need to prove how it helps children of legal immigrants. I suspect there is more to your story than you are letting on. If you are 21 now, you would have been 19 in 2005 and well able to understand the consequences of becoming an illegal immigrant. As someone said the F1 was an option if you wanted to maintain legal status.

    Hi,
    Here is my situation:

    Company A:
    EB2 PD Aug 2006
    140 Approved
    485 Applied July '07 (Got EAD and AP for myself and wife. I am still on H1B but wife used EAD)
    Still working with Company A and intend to work with them for another couple of years.

    Company B:
    EB2 PD Nov 2005 (Substitution labor)
    140 Approved.



    Can I interfile or do the PD porting so that I can get the older PD? If so, do I have to work for Company B?
    I dont have a copy of the LCA and I may not have the original of the approved 140. Can I use a copy of 140 approval notice to apply for the interfile?
    Do I need any kind of document from Company B like employment letter in future ?
    Does the PD need to be current to interfile?
    Do I need to work for Company B?
    Does this process in anyway create problems for my current 485 status? My wife used EAD but I have been on H1B with the company that filed for my 485.
    I already completed 180 days after filing 485. So, I can use AC21. Will this interfiling process have any impact on that?
    How would I know that interfiling process completed successfully?
    If USCIS denys the interfile I submitted, does that have any impact on my current 485 process?
    If I want to use AC21, does that new job need be similar to Company A or Company B job requirement?

    Hi,
    I am one of the concurrent filing applicants. I filed my 140 and 485 on July 2. Can you give me a link for this memo ? Also if I invoke ac 21 do i need to file the g28 on 485 ? and what is g28 exactly for ?

    In your case, to file AC-21 to change employers, you need to have approved I-140 and will have to wait for 180 days from the 485 receipt.

    Just google search Yates memo pdf and you will find it. G-28 is a form that is filed to authorize a lawyer to represent you with USCIS.

    Sometimes paranoia gets the better of us.

    I have access to a lot of "extra" stuff, as you can tell from the blog. It has been a long and tiring fight, but someone has to do it.

    RonHira did a pretty accurate transcript. The funniest part was the way Donna was talking to the folks there. It seemed very much like the way a PreSchool teacher talks to her class. She was speaking slowly, repeating stuff multiple times, adding extra emphasis on phrases (like "talking point") and repeating them. Then someone would suggest something and she will go "That is a perfect post", and then he/she will try to say something, and Donna would go "No No, what you said first was perfect, don't deviate".

    I was feeling bad for the Antis.
